Terms and Conditions For My Fence Guy

Welcome to My Fence Guy. These Terms and Conditions (“Terms”) govern your access to and use of the website myfenceguyct.com (the “Site”) and any fence installation, repair, or related services provided by My Fence Guy (“Company,” “we,” “us,” or “our”). By accessing the Site or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Site or services.
1. Acceptance of Terms
By accessing or using our Site, requesting a quote, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and Disclaimer, which are incorporated herein by reference. These Terms constitute a legally binding agreement between you and My Fence Guy.
2. Services Provided
My Fence Guy provides fence installation and related services including, but not limited to, residential fencing, commercial fencing, industrial fencing, agricultural fencing, vinyl fencing, wood fencing, aluminum fencing, chain link fencing, ornamental fencing, pool fencing, pet fencing, cedar planters, estate gates, and railings. Our services are available throughout Connecticut and select areas of New York. A complete list of service areas is available on our Site.
3. Eligibility
Our Site and services are intended for individuals who are at least 18 years old and have the legal capacity to enter into binding contracts. By using our Site or services, you represent and warrant that you meet these eligibility requirements. Our Site is not intended for children under 13, and we do not knowingly collect information from children under 13.
4. Quotes and Estimates
Quotes and estimates provided by My Fence Guy are based on information provided by the customer and an assessment of the project scope at the time of the quote. Quotes are valid for 30 days unless otherwise specified. Final pricing may vary based on actual site conditions, changes in material costs, or modifications to the project scope. A formal contract or agreement will be provided for all accepted projects, which will supersede any prior quotes or estimates.
5. Service Agreements and Contracts
All fence installation projects require a written service agreement or contract signed by the customer. The service agreement will detail the scope of work, materials, pricing, payment terms, timeline, and any warranties. The terms of the signed service agreement will govern the specific project and take precedence over these general Terms where there is a conflict.
6. Payment Terms
Payment terms will be outlined in the service agreement for each project. Generally, a deposit may be required before work begins, with the remaining balance due upon completion of the project or as specified in the agreement. We accept various forms of payment as detailed in the service agreement. Late payments may be subject to interest charges and/or collection fees as permitted by applicable law.
7. Cancellation and Refund Policy
Cancellation and refund policies will be outlined in the individual service agreement for each project. Generally, customers may cancel a project before work has begun for a full refund of any deposit, less any costs already incurred by the Company for materials, permits, or other project-related expenses. Once work has commenced, refunds will be prorated based on work completed and materials ordered or installed.
8. Customer Responsibilities
Customers are responsible for:
- Providing accurate information about property boundaries and conditions
- Obtaining any necessary permits or approvals required by local authorities, unless otherwise agreed
- Ensuring clear access to the work area
- Marking or identifying underground utilities, irrigation systems, and other buried features
- Notifying neighbors when required by local ordinances or HOA rules
- Complying with all applicable HOA and local zoning regulations
9. Permits and Compliance
Fence installation may require permits from local municipalities. Unless otherwise agreed in writing, the customer is responsible for obtaining necessary permits. My Fence Guy can assist with the permit process for an additional fee where applicable. All work will be performed in accordance with applicable building codes and regulations.
10. Property Lines and Surveys
Customers are responsible for knowing and marking their property lines before fence installation begins. My Fence Guy is not responsible for fences installed on incorrect property lines based on customer-provided information. We strongly recommend obtaining a professional survey if property boundaries are uncertain. Any costs associated with fence relocation due to property line disputes are the responsibility of the customer.
11. Underground Utilities
Before any digging begins, customers must contact Call Before You Dig (811) to have underground utilities marked. My Fence Guy is not responsible for damage to unmarked or improperly marked underground utilities, irrigation systems, septic systems, or other buried features. Repair costs for damage to unmarked utilities are the customer’s responsibility.
12. Warranty
Warranty terms for materials and workmanship will be specified in the service agreement for each project. Manufacturer warranties on materials (such as vinyl, aluminum, or wood) are passed through to the customer. My Fence Guy’s workmanship warranty does not cover damage resulting from improper use, accidents, natural disasters, normal wear and tear, or failure to maintain the fence according to provided guidelines.
13. Limitation of Liability
To the fullest extent permitted by law, My Fence Guy’s total liability for any claims arising from our services or your use of our Site shall not exceed the amount paid by you for the specific services giving rise to the claim. In no event shall My Fence Guy be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of our Site or services.
14. Indemnification
You agree to indemnify, defend, and hold harmless My Fence Guy, its owners, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or third-party rights; (c) inaccurate information you provided; or (d) your use of our Site or services.
15. Intellectual Property
All content on the Site, including text, graphics, logos, images, photographs, videos, and software, is the property of My Fence Guy or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. Certain content, including images and written materials, may have been created with the assistance of artificial intelligence tools. You may not reproduce, distribute, modify, or create derivative works from any content on our Site without our prior written consent.
16. User Conduct
When using our Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to any portion of the Site or any systems connected to the Site
- Interfere with or disrupt the Site, servers, or networks connected to the Site
- Transmit any viruses, malware, or other harmful code
- Collect or harvest any personally identifiable information from the Site
- Use any automated means to access the Site without our permission
17. Third-Party Links
Our Site may contain links to third-party websites or resources. These links are provided for your convenience only. We have no control over the content of these sites and accept no responsibility for them or for any loss or damage that may arise from your use of them. Your use of third-party sites is subject to the terms and policies of those sites.
18. Site Availability
We strive to keep our Site available 24 hours a day, 7 days a week. However, we do not guarantee uninterrupted access to our Site. We may suspend, withdraw, discontinue, or change all or any part of our Site without notice. We will not be liable if the Site is unavailable at any time or for any period.
19. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Connecticut, and you hereby consent to the personal jurisdiction of such courts.
20. Dispute Resolution
In the event of any dispute arising out of or relating to these Terms or our services, you agree to first attempt to resolve the dispute informally by contacting us at (203) 746-1100. If the dispute cannot be resolved informally within 30 days, either party may pursue formal legal remedies in accordance with the Governing Law and Jurisdiction section above.
21. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
22. Entire Agreement
These Terms, together with our Privacy Policy, Disclaimer, and any service agreements executed for specific projects, constitute the entire agreement between you and My Fence Guy regarding your use of the Site and our services. These Terms supersede all prior agreements, understandings, and communications, whether oral or written.
23. Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
24. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site with an updated “Effective Date.” Your continued use of the Site or services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
